Duties
Find the Appeals Petition (PDF). The Board of Zoning Appeals hears and provides recommendations as required under the terms of the Village Zoning Ordinance. The Board of Zoning Appeals has certain criteria that need to be met before a variation or modification can be granted. Variation and modification requests may include variations from minimum lot requirements; bulk regulations; off-street parking and loading requirements; nonconformities; modifications for fences and signs; and other provisions of the Zoning Ordinance. Additionally, requests to hear and make recommendations as to appeals from, and review any order, requirement, decision, or determination, made by the administrative official charged with the enforcement of the Village Zoning Ordinance. A concurring vote of 4 members of the Board of Zoning Appeals shall be necessary to recommend the request be granted to the petitioner. The Board of Zoning Appeals submits to the Village Board of Trustees its recommendations accompanied by findings of fact specifying the reason or reasons thereof.
Rules
The Board of Trustees considers the Board of Zoning Appeals recommendation and makes a final decision.
(a) The Board of Zoning Appeals shall:(b) The concurring vote of 4 members of the board shall be necessary to recommend reversal of any order, requirement, decision, or determination of the officer from whom an appeal is taken or to decide in favor of the applicant any matter upon which it is required to pass under this Division, or to recommend any variation or modification in the Division to the corporate authorities. - Hear and make recommendations as to appeals from, and review any order, requirement, decision, or determination, made by the administrative official charged with the enforcement of the Village Zoning Ordinance;
- Hear all applications for variations to the provisions of the Zoning Ordinance and shall submit to the Village Board its recommendations accompanied by findings of fact specifying the reason or reasons therefore;
- Hear and make recommendations as to all matters referred to it or upon which it is required to pass under the terms of this Division or the Village Zoning Ordinance.
